Why is UGC Important?

At Coordonné Brands, S.L.U. (hereinafter, “Coordonné”), we love discovering how our customers and followers incorporate our products into their interior design projects and share their experiences through social media and other digital channels. This authentic and spontaneous content generated by users (hereinafter, the “UGC Content”) constitutes a valuable showcase of the real-life application of our products and the experience associated with our brands.

UGC Consent

When Coordonné requests authorization to use specific UGC Content through a direct message, comment, email, or any other means, the user’s affirmative response, including expressions such as “I Accept,” “Yes,” or the use of the hashtag #YesCoordonne, shall constitute full acceptance of these UGC Terms of Use.

Purposes for Using UGC Content

Coordonné may use UGC Content for promotional, advertising, commercial, corporate, editorial, and informational purposes related to its products, services, and brands, including, but not limited to:

• Coordonné websites and digital platforms.
• Corporate social media accounts.
• Newsletters and commercial communications.
• Paid and organic advertising campaigns.
• Advertisements on digital platforms and social media.
• Search engine and video platform advertising.
• Marketplaces and e-commerce platforms.
• Printed and digital marketing materials.
• Catalogues, sales dossiers, and corporate presentations.
• Public relations and corporate communications.
• Trade fairs, events, and exhibitions.
• Materials used by Coordonné distributors, sales agents, and authorized partners.

Terms of the UGC License

The UGC User grants Coordonné a royalty-free, non-exclusive, transferable, worldwide, and perpetual license to use the authorized UGC Content, including transfer to companies within the Coordonné Group.

This license includes all rights necessary to reproduce, distribute, publicly communicate, transform, adapt, edit, modify, crop, combine with other materials, and translate the UGC Content in any format, medium, support, or technology currently known or developed in the future.

UGC User Warranties

The UGC User represents and warrants to Coordonné that they own all rights necessary to the UGC Content or have obtained all required authorizations to grant the rights provided under these Terms. Such rights granted to Coordonné include, among others, intellectual property rights, industrial property rights, image rights, privacy rights, and data protection rights.

The UGC Content does not contain any unlawful, defamatory, offensive, misleading material, nor does it violate any applicable laws or regulations.

The UGC User has obtained all necessary permissions from any identifiable individuals appearing in the UGC Content, including, where applicable, the consent of the legal representatives of minors.

Accordingly, the UGC User agrees to indemnify and hold harmless Coordonné from and against any claims, damages, costs, penalties, and liabilities arising from a breach of these warranties.

UGC User Credits

The UGC User expressly authorizes Coordonné to use, together with the UGC Content, their name, username, alias, profile picture, image, and any other public information associated with the original publication.

Coordonné assumes no obligation to use the UGC Content or to keep it published for any specific period and may remove, modify, archive, or cease using it at any time without prior notice or justification.

UGC User Rights

The UGC User may request the future removal of UGC Content by sending a request to hola@coordonne.com. Coordonné will make reasonable efforts to cease future use of the content on its own channels, without prejudice to materials already produced, distributed, published, or committed prior to receiving such request, for which the authorization shall remain valid.

The processing of personal data associated with UGC Content shall be carried out in accordance with the Privacy and Cookies Policy and applicable data protection legislation published on the website. Data subjects may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability by contacting hola@coordonne.com.

Governing Law and Dispute Resolution

The provisions regarding Governing Law and Dispute Resolution set out in the Legal Notice of this website shall apply.
